Once upon a time, working on a prevailing wage project was easy. Contractors knew when the project was prevailing wage (the project was a public project), and they knew that they had to submit certified payrolls showing that they paid their employees the prevailing wage in the area (and actually pay those employees that wage). Now, between the expansion of prevailing wage to cover not only public projects, but also private projects which receive a public benefit, and the new contractor registration scheme, taking and working on prevailing wage projects just got more complicated. The purpose of this discussion is to try to straighten out the confusion and let contractors know what new obstacles they may be facing.

Gregory J. Spaun is a Partner at Welby, Brady & Greenblatt, LLP, practicing construction and commercial litigation, insurance coverage litigation and real estate and property litigation. Mr. Spaun started his legal career in the state court system, working as a law clerk at the Appellate Division, Second Department, the nation’s busiest appellate court. After that, he entered private practice, and subsequently came to work at Welby, Brady & Greenblatt, LLP, a premier regional construction law firm. Mr. Spaun is a resident of LaGrange in Dutchess County, and he is active in his community as volunteer attorney/client fee arbitrator for the Ninth Judicial District and a member of the Dutchess County Bar Association’s Grievance Committee. He was formerly a volunteer emergency medical technician with the LaGrange Fire District and, prior to that, an EMS Crew Chief and Director with the Glen Oaks Volunteer Ambulance Corps in Queens, New York.
